Rental and Housing Law in the Netherlands – Tenant Rights and Legal Rules (2025)
Dutch rental law protects tenants well. Whether you live in social housing or a private sector apartment, understanding your legal position is essential.
🏠 1. Types of Housing
- Social Housing:
- Rent regulated by a points system (woningwaarderingsstelsel).
- Monthly rent below €879.66 (as of 2024).
- Private Sector Housing:
- Rent above €879.66.
- Fewer restrictions, but rent caps apply until 2029.
📈 2. Rent Increase in Social Housing (as of July 1, 2025)
- Rent ≥ €350 → Max. 5% annual increase
- Rent < €350 → Max. €25 increase
- Based on income:
- Middle income: + €50
- High income: + €100
Note: income from two years earlier is used to assess eligibility.
💶 3. Rent Increase in Private Sector (until 2029)
- Legal cap = CPI + 1%
(CPI = Consumer Price Index)
→ Example: 2024 CPI ≈ 4.5% → cap = 5.5%
🔄 4. Frequency of Rent Increase
- Maximum once every 12 months.
- Additional increase only allowed for home improvements.
📬 5. Objection (Rent Disputes)
- You have 4 months to file an objection via Huurcommissie.
- Applies to both social and private sector housing.
- Rent increase must be legally stated in your contract, or it may be invalid.

Eviction is only legal with a court ruling. Valid reasons include:
- Repeated non-payment
- Illegal subletting
